NOTICE OF TRUSTEE’S SALE

Default having been made in the terms, conditions, and payments provided for in that certain Deed of Trust dated June 8, 2012, and registered June 28, 2012, of record in Book 67, Pages 1767, Register’s Office for Jackson County, Tennessee, (hereafter “Deed of Trust”) from or executed by Cheryl A. Johnson and Donald A. Johnson deceased on or about November 11, 2010 (“Borrowers”) to William D. Birdwell, Trustee, securing the indebtedness therein described, which indebtedness is now due and unpaid, and has been declared in default by Builtwell Bank, formerly known as First Volunteer Bank, the lawful owner and holder thereof; and,

The undersigned, William D. Birdwell, Esq., Trustee, gives notice as follows:

NOW, WHEREFORE, I, William D. Birdwell, Esq., Trustee, pursuant to said Deed of Trust, having been requested by Builtwell Bank, formerly known as First Volunteer Bank, the owner and holder of said indebtedness so to do, and by virtue of the authority and power vested in me by said Deed of Trust will, on March 1, 2024 at 12:00 p.m., at the South Door of the Jackson County Courthouse, 101 East Hull Avenue, Gainesboro, County of Jackson, Tennessee 38562, sell at public outcry to the highest bidder for cash (or credit upon the indebtedness secured if the lawful owner and holder thereof is the successful purchaser), free from the equity of redemption, statutory right of redemption, homestead, dower, elective share, and appraisement relating to the property, all of which have been expressly waived by Borrowers in said Deed of Trust, the following-described property located in Jackson County, Tennessee, which, pursuant to TCA 35-5-104(2) has a Concise Description as described in the complete legal description of the property contained in Deed of Trust recorded in Book 67, Pages 1767, Register’s Office Jackson County, Tennessee, which is the previous and last conveyance of the property, and Common Description of B M Johnson Lane 212, and Control Map 082P; Group A; and Parcel 002.00, as assessed by the Assessor of Property, Jackson County, Tennessee described as follows:

The Land referred to herein below is situated in the County of JACKSON, State of Tennessee, and is described as follows:

The following described tract or parcel of land located in the Twelfth Civil District of Jackson County, Tennessee, as follows: Beginning on a Maple in the Bill Haney line; thence Eastwardly 164 feet to a marked Oak; thence Northwardly with a terrace 274 feet to a stake; thence Westwardly 164 feet to a Maple; thence Southwardly with a Hollow to a stake in the Hop Anderson's line; thence Southwardly with Hop Anderson's line to a stake Bill Haney line; thence Northwardly with said Bill Haney to a Maple, to point of beginning, containing by estimation Two (2) acres more or less, but this land is conveyed by the boundary and not by the acre. 

Included in the above description but expressly excluded from this conveyance is property previously conveyed in a Warranty Deed from Donald A. Johnson and Cheryl A. United States Internal Revenue Service did not register a Lien or claim of lien in the Register’s Office of Jackson County, Tennessee more than 30 days prior to the sale date;

The State of Tennessee, Tax Enforcement Division, did not register a Lien or claim of lien in the Register’s Office of Jackson County, Tennessee more than 30 days prior to the sale date;

This sale is being sold subject to any other liens, easements, encumbrances, property taxes, rights of redemption of taxing entities and other matters not mentioned above, which are prior in right to the lien of the aforesaid Deed of Trust.

Pursuant to TCA 35-5-101(e), a copy of the above notice, as required in TCA 35-5-104, was served upon the above referenced Debtor(s) and Interested Parties, by lodging same with the US Mail Certified Mail, Return Receipt Requested, postage prepaid, for delivery to the addresses indicated on or before the first date of publication.

Pursuant to the Service Members Civil Relief Act of 2003, confirmation was obtained on November 22, 2023, that there is no information in the Department of Defense data center that indicates Cheryl A. Johnson is currently on active military duty.

Pursuant to TCA 35-5-101(a)(b), this Notice of Trustee’s Sale shall be published in Jackson County Sentinel, a newspaper published in Jackson County, Tennessee, the county where the land is located and the sale is to be made. 

The purchase price is due and payable, in full, at the conclusion of the Trustee sale in the form of a cashier’s check endorsed to the order of William D. Birdwell Escrow. Personal checks shall not be accepted.  For any amount the cashier’s check exceeds the purchase price, the Trustee shall refund said excess payment to the purchaser following the deposit of the cashier’s check into his trust account.

This sale of property is subject to tenants in possession, if any.

The sale held pursuant to this Notice may be rescinded at the Trustee’s option at any time. Pursuant to TCA 35-5-101(f) the Trustee may adjourn the day of the sale to another day, time, and place.

The Trustee is attempting to collect a debt. Any information obtained shall be used for that purpose.
